Terms of Service

These terms explain how Formahand works, what you can expect from us, and what we expect from buyers and sellers who use the marketplace. Please read them carefully.

1. Agreement to these terms

These Terms of Service (the “Terms”) are a binding agreement between you and Formahand (“Formahand”, “we”, “us”). They govern your access to and use of the Formahand website, marketplace, and related services (together, the “Service”).

By creating an account, browsing, buying, selling, or otherwise using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Service.

You must be at least 18 years old and able to form a binding contract to use Formahand. If you use the Service on behalf of a business, you confirm you are authorized to bind that business to these Terms.

2. Our role as a marketplace

Formahand is a venue that connects independent makers (“sellers”) with people who want made-to-order handcraft (“buyers”). We provide discovery, a request-and-quote flow, order management, payment processing, escrow, and optional manufacturing support.

The contract for any purchase is between the buyer and the seller. Formahand is not the seller, manufacturer, or provider of the items and services listed by sellers, and, except where we act as the platform of record for payments, we are not a party to that contract.

Formahand is a non-managed marketplace: sellers set and are responsible for their own shop policies, including processing times, shipping, returns, exchanges, and cancellations. Those policies, together with any custom terms a seller and buyer agree to in a request, quote, or message, apply to each order alongside these Terms.

3. Your account

Formahand accounts are passwordless. You sign in with a one-time code sent to your email, or with a supported single sign-in provider. You are responsible for keeping access to your email and account secure and for all activity that occurs under your account.

You agree to provide accurate information and to keep it up to date. Each person may operate one shop. You may not use the Service if we have previously suspended or removed you, or if doing so would violate any applicable law.

Tell us promptly at support@formahand.com if you believe your account has been accessed without your permission.

4. Buying on Formahand

You can buy a seller’s published listing, or post a request describing what you want and receive quotes from sellers. Accepting a quote, or checking out a listing, creates an order.

Most items are made to order and may be personalized to your specifications. Because of this, availability, lead times, shipping, and returns are governed by the seller’s shop policies and any custom terms shown at the time of purchase. Review those details before you buy.

When you place an order you authorize us to charge your selected payment method for the item price, applicable shipping, and any taxes shown at checkout.

5. Selling on Formahand

To sell, you open a shop and publish listings or respond to buyer requests with quotes. You are responsible for your listings, images, descriptions, pricing, policies, communications, and for fulfilling accepted orders as described.

You agree that everything you offer is your own work or something you are authorized to sell, is described accurately, and complies with all applicable laws, including consumer-protection, product-safety, import/export, and tax rules.

To receive payouts you must complete onboarding with our payments provider (see “Fees and payments”). You are responsible for the taxes on your sales and for any regulatory registrations your business requires.

6. Content and intellectual property

You keep ownership of the content you submit (listings, images, text, messages, and other materials). You grant Formahand a worldwide, non-exclusive, royalty-free license to host, store, display, reproduce, and distribute that content solely to operate, promote, and improve the Service.

You must not post content that infringes anyone’s intellectual property, privacy, or other rights, and you must have the rights needed to grant the license above.

If you believe content on Formahand infringes your rights, contact us at support@formahand.com with enough detail to identify the material and your claim, and we will review and respond.

7. Fees and payments

Buyers pay through the Service. Payments and seller payouts are processed by our third-party payments provider, Stripe, and are also subject to Stripe’s terms. Formahand does not store your full card details.

Formahand charges sellers a commission on each completed sale. The default commission is 1% of the item price, and the applicable rate for a category is shown to sellers before publishing. We may change fees on a going-forward basis with notice.

Buyer payments are held in escrow and released to the seller after the order is delivered and confirmed, or after the automatic-confirmation window passes (see “Escrow and order protection”). New or higher-risk sellers may have a portion of each payout held as a rolling reserve for a limited period to cover refunds and chargebacks; the reserve relaxes as a shop builds trust.

Prices are shown in the listed currency. You are responsible for any taxes, duties, or fees that apply to your purchase or sale and that are not collected by Formahand at checkout.

8. Escrow and order protection

When you pay for an order, the funds are held by the platform rather than sent straight to the seller. Funds are released to the seller when you confirm you received your order, or automatically after the confirmation window shown on the order if you take no action.

If something goes wrong, you can open a case before the funds are released or within the applicable window (see “Cases and disputes”). Refunds, when due, are returned to your original payment method.

9. Cases and disputes

If an order does not arrive, arrives damaged, or is not as described, you can open a case on that order. Opening a case pauses release of the escrowed funds while it is reviewed.

The seller can respond and resolve the case, including by issuing a refund. If you and the seller cannot resolve it, you can escalate the case to Formahand, and we may review the order and decide an outcome, which can include refunding the buyer or releasing funds to the seller.

Formahand’s role in a dispute is limited to administering the escrowed funds and applying these Terms and the seller’s policies. Our decision on the release or refund of escrowed funds is final with respect to those funds; it does not limit any rights you may have directly against the other party under applicable law.

10. Prohibited items and conduct

You agree not to use Formahand to do any of the following:

  • List, sell, or buy anything illegal, counterfeit, stolen, unsafe, or that you are not authorized to sell.
  • Infringe intellectual property or other rights, or misrepresent who made an item.
  • Defraud, deceive, or harm other users, or manipulate reviews, quotes, or prices.
  • Circumvent the Service’s fees, escrow, or payment flow, including by arranging payment off-platform to avoid protections or commission.
  • Interfere with, scrape, overload, or attempt to gain unauthorized access to the Service or its security.
  • Harass, abuse, or threaten other users or our team.

We may remove content, and suspend or close accounts, that we reasonably believe violate these Terms or applicable law.

11. Disclaimers

The Service is provided “as is” and “as available”. To the fullest extent permitted by law, Formahand disclaims all warranties, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

Because purchases are contracts between buyers and sellers, Formahand does not warrant the quality, safety, legality, or accuracy of any listing, item, service, or user, and does not guarantee that any request will receive a quote or that any order will be fulfilled.

12. Limitation of liability

To the fullest extent permitted by law, Formahand and its officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of or relating to your use of the Service.

To the fullest extent permitted by law, Formahand’s total liability for any claim relating to the Service is limited to the greater of the fees Formahand earned on the transaction giving rise to the claim, or one hundred U.S. dollars (US$100).

Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

13. Indemnification

You agree to indemnify and hold Formahand harmless from any claims, damages, losses, and reasonable expenses (including legal fees) arising out of your content, your listings or sales, your use of the Service, or your breach of these Terms or of any law or third-party right.

14. Suspension and termination

You may stop using Formahand at any time. We may suspend or terminate your access if you violate these Terms, create risk or possible legal exposure, or if we discontinue the Service.

Provisions that by their nature should survive termination (including fees owed, content licenses already granted, disclaimers, limitations of liability, and indemnities) will survive.

15. Changes to these terms

We may update these Terms from time to time. When we make material changes, we will update the “Last updated” date and, where appropriate, notify you. Your continued use of the Service after changes take effect means you accept the updated Terms.

16. Governing law and disputes

These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-laws rules, except where mandatory consumer-protection laws of your country of residence apply.
